Terms of Use
Section 1
Who this applies to
These terms apply to all users of the Maple toolkit at toolkit.petcareprocanada.ca. The toolkit is owned by Canadian Pet Care Professionals Inc. (CPCP) and is built and operated on their behalf by Barketing Solutions. References to "we," "us," or "our" in these terms refer to CPCP and Barketing Solutions collectively.
Access to Maple is restricted to current CPCP members. By using the toolkit, you confirm that you are an active CPCP member in good standing. CPCP reserves the right to revoke toolkit access at any time if membership lapses or if these terms are violated.
Section 2
What Maple is
Maple is an AI-powered marketing assistant built exclusively for Canadian Pet Care Professionals members. It uses artificial intelligence to generate marketing content, client emails, social media captions, and other business materials based on the profile information you provide.
Maple is a member benefit, not a professional marketing, legal, or financial service. Outputs are suggestions and starting points — not professional advice of any kind.
Maple is provided as a member benefit and may be modified, updated, or discontinued at any time. CPCP does not guarantee uninterrupted availability of the toolkit.
Section 7
Acceptable use
By using Maple you agree to use it only for lawful purposes in connection with your legitimate Canadian pet care business. You agree not to:
- Use Maple to generate false, misleading, or defamatory content about competitors, clients, or any other person or business
- Claim credentials, certifications, or CPCP membership status in generated content that you do not actually hold
- Use outputs to make claims that violate Canadian advertising standards, PIPEDA, or any applicable provincial privacy law
- Attempt to reverse-engineer, scrape, or systematically extract content from the toolkit
- Share your CPCP member login or toolkit access with non-members
- Use Maple to generate content on behalf of a business you do not own or operate
CPCP reserves the right to suspend toolkit access for any member found to be in violation of these terms.
Section 8
AI-generated outputs
All content produced by Maple is generated by artificial intelligence. You are responsible for reviewing all outputs before publishing or sending them. Specifically:
- Review before posting. AI-generated content may contain inaccuracies, outdated information, or phrasing that does not accurately reflect your business. Always read outputs before use.
- Accuracy is your responsibility. If Maple generates content referencing a credential, certification, or service you do not offer, do not publish it. You are responsible for ensuring everything you post is truthful and accurate.
- No guarantee of results. CPCP makes no guarantee that content produced by Maple will achieve any specific marketing outcome, engagement rate, search ranking, or booking result.
- Copyright and originality. AI-generated content is not protected by copyright in the same way original human creative work is. CPCP does not warrant that outputs are entirely original or free from similarity to other AI-generated content.
Section 9
Use at your own risk — Limitation of liability
Maple is provided as-is, at your own risk. You are solely responsible for every piece of content you publish, every email you send, and every business decision you make based on outputs from this tool. CPCP and Barketing Solutions are not responsible for any consequences of how you use Maple or what you do with what it generates.
To the maximum extent permitted by applicable Canadian law, Canadian Pet Care Professionals Inc. and Barketing Solutions are not liable for any direct, indirect, incidental, or consequential damages arising from your use of Maple or the content it generates, including but not limited to:
- Loss of business, revenue, or bookings
- Damage to your professional reputation arising from published AI-generated content
- Any claim, complaint, or legal action by a third party arising from content you published or sent that was generated by Maple
- Inaccurate, incomplete, or misleading content produced by the AI that you chose to publish without review
- Any regulatory, advertising standards, or professional conduct issue arising from your use of generated content
- Interruption, errors, or unavailability of the toolkit
Your use of Maple is entirely at your own discretion and risk. CPCP and Barketing Solutions make no warranties, express or implied, about the fitness, accuracy, or completeness of any output produced by Maple.
Section 9b
Indemnification — You cannot use Maple against CPCP
By using Maple, you agree to indemnify, defend, and hold harmless Canadian Pet Care Professionals Inc., Barketing Solutions, and their respective directors, officers, employees, and representatives from and against any and all claims, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or related to:
- Your use of Maple or any content it generates
- Any content you publish, post, send, or otherwise distribute that was generated or assisted by Maple
- Your violation of these Terms of Use
- Any false, misleading, or inaccurate claim you make using AI-generated content
- Any third-party complaint, dispute, or legal action arising from your use of Maple outputs
This means that if your use of Maple leads to a complaint, legal claim, or dispute — whether from a client, competitor, regulatory body, or any other party — you are responsible for handling and covering that. CPCP and Barketing Solutions cannot be named as a party to, or held responsible for, any dispute arising from how you choose to use this tool.
Additionally, you agree not to use anything generated by Maple, or your experience using Maple, as the basis for any claim, complaint, or legal action against CPCP or Barketing Solutions.
Section 10
Changes to these terms
CPCP may update these terms at any time. When we make material changes we will update the "Last updated" date at the top of this page and notify members through the CPCP Mighty Networks community. Continued use of Maple after changes are posted constitutes acceptance of the updated terms.
Privacy Notice
Section 3
What data we collect and how we use it
When you use Maple, you voluntarily provide the following information through the profile setup:
- Your first name and business name
- Your city, province, and service areas
- Your services, years in business, business type, and team size
- Your credentials, certifications, and CPCP membership tier
- Your brand tone, language preference, and business differentiators
- Your email address (used only to save and restore your profile across devices)
- Images you upload (for the Caption This feature)
This information is used exclusively to personalise the marketing content Maple generates for your business. We do not use it for advertising, we do not sell it, and we do not share it with any third party except as described in Section 4 below.
CPCP products are ad-free. We do not allow advertisers to influence the content Maple produces and we do not sell member data. Ever.
Section 3b
Anonymous and aggregated data — shared back with members
CPCP and Barketing Solutions may use anonymised, aggregated, non-identifiable data derived from toolkit usage to improve the platform and to share industry insights back with CPCP members. This is a membership benefit — the more members use Maple, the more useful and specific these insights become for the whole community.
Examples of what this looks like in practice:
- "The most-generated content type across CPCP members this month was seasonal pet safety posts"
- "Dog walking is the top service listed by CPCP members in Ontario. Cat sitting leads in BC."
- "The most common marketing goal among CPCP members right now is increasing summer bookings"
- "Pet First Aid certification is the most frequently listed credential among CPCP Verified Pros"
These insights may be shared with CPCP members through the Mighty Networks community, CPCP newsletters, member resources, or CPCP social media. They may also be used by Barketing Solutions for industry reporting and to improve the toolkit.
What this never includes: No individual member's name, business name, city, credentials, email, or any other detail that could identify a specific person or business. Aggregated means combined across all members — individual data is never extracted, published, or shared.
If you do not want your anonymised usage included in aggregate analysis or member insights, you can opt out at any time by emailing hello@petcareprocanada.ca with the subject line "Maple Data Opt Out." We will exclude your profile from any future analysis. Opting out does not affect your access to Maple.
Section 4
Third-party processing (Anthropic)
Maple generates content using the Claude AI platform, operated by Anthropic, PBC (San Francisco, CA, USA). When you request a generation, your profile data and any images you upload are transmitted to Anthropic's API servers to produce the output.
This means your business profile information is processed by Anthropic's systems as part of every generation request. Anthropic is a sub-processor under our use of their API.
- Anthropic does not store your data beyond what is required to process the immediate API request, in accordance with their API data use policy.
- API data is not used by Anthropic to train their models by default under their current API terms.
- You can review Anthropic's privacy policy at anthropic.com/privacy
Important clarifications about AI ownership and data:
- Nobody owns the AI. Claude is Anthropic's platform. CPCP and Barketing Solutions use it but do not own it. You own the outputs Maple generates for your business.
- Your data is not used to train AI models. Under Anthropic's API terms, data submitted through the API is not used to train their models by default. Your profile and content requests are processed to generate a response and are not retained by Anthropic for training purposes.
- Outputs are not exclusive. Because multiple members use the same AI platform, it is possible that two members could receive similar outputs for similar inputs. This is a feature of how large language models work, not a data breach.
We recommend not entering sensitive personal information (such as client names, client addresses, or financial details) into Maple's profile fields or chat. Enter only information that describes your business, not your clients.
Section 5
How your data is stored
Your Maple profile is stored in two places:
- Your browser (localStorage). Your profile is saved locally in your browser so it loads automatically when you return. This data stays on your device and is not accessible to CPCP, Barketing Solutions, or anyone else unless you explicitly save it to the server.
- The toolkit server (optional, for cross-device access). If you enter your email address and save your profile, a copy is stored on the server that hosts the Maple toolkit. This server is operated by Barketing Solutions on behalf of CPCP (hosted on BigScoots private server, Canada). The file is associated with a hashed (one-way encrypted) version of your email address. Neither CPCP nor Barketing Solutions staff routinely access individual profile files.
Images uploaded to Caption This are transmitted to Anthropic's API to generate captions and are not stored on the toolkit server.
Chat history in Ask Maple exists only in your current browser session. It is not stored on any server or retained between sessions.
Section 6
Your rights under Canadian privacy law
As a Canadian resident, you have rights under the Personal Information Protection and Electronic Documents Act (PIPEDA) and, if you are in Quebec, under Law 25 (Act respecting the protection of personal information in the private sector).
These rights include:
- Right to access. You may request a copy of the profile data CPCP holds for you at any time.
- Right to correction. You may update your profile at any time directly within the Maple toolkit.
- Right to deletion. You may request that CPCP delete your server-side profile data. See Section 11 for how to make this request. Browser-stored data can be cleared at any time by clearing your browser's localStorage.
- Right to withdraw consent. You may stop using Maple at any time. If you wish to have your server-side profile deleted, contact us using the details in Section 11.
CPCP will respond to privacy requests within 30 days in accordance with PIPEDA requirements.
Section 11
No professional advice — use at your own discretion
Maple does not provide professional advice of any kind. Nothing generated by this tool is legal advice, financial advice, veterinary advice, regulatory guidance, or professional marketing advice. CPCP is a membership and community organisation, not a professional services firm.
Specifically, outputs from Maple:
- Are not a substitute for legal advice. If you have questions about contracts, liability, employment, or business registration, consult a lawyer.
- Are not a substitute for financial or tax advice. If you have questions about pricing, CRA obligations, or business finances, consult an accountant.
- Are not veterinary or animal health guidance. Maple may generate educational pet health content for marketing purposes — this is not veterinary advice and should not be presented as such.
- Are not guaranteed to comply with any specific advertising standard, platform policy, or professional conduct rule. It is your responsibility to ensure your marketing complies with all applicable rules in your province.
- Are not a guarantee of any business result. CPCP and Barketing Solutions make no representation that using Maple will increase bookings, improve search rankings, grow your audience, or produce any other specific outcome.
You use Maple entirely at your own discretion and risk. Every output should be reviewed, edited where needed, and approved by you before use. You are the professional. Maple is a tool to support your work, not replace your judgment.
Section 12
Intellectual property
The Maple toolkit — including its design, structure, system prompts, methodology, code, branding, and all underlying tools — is the intellectual property of Barketing Solutions, built on behalf of and licensed to Canadian Pet Care Professionals Inc.
By using Maple, you agree not to:
- Copy, reproduce, reverse engineer, or attempt to replicate any part of the toolkit or its underlying methodology
- Share screenshots, recordings, or descriptions of the toolkit's internal prompts or structure with any third party for the purpose of replicating it
- Build, commission, or assist in building a competing tool that replicates Maple's approach, structure, or outputs
- Use the Maple name, branding, or CPCP branding in any unauthorised way
The content Maple generates for your business belongs to you. You own your outputs. CPCP and Barketing Solutions do not claim ownership of anything Maple writes for you.
The tool itself, and everything that makes it work, belongs to Barketing Solutions and CPCP.
Section 13
Membership, access, and what happens when membership ends
Maple is a benefit of active CPCP membership. Access is conditional on your membership remaining current and in good standing.
- Lapsed membership. If your CPCP membership expires or is not renewed, your access to Maple may be suspended without notice. You will not receive a refund of any membership fees on the basis of toolkit access or unavailability.
- Terminated membership. If your CPCP membership is terminated for any reason, including a violation of the Code of Ethics or these Terms of Use, your toolkit access will be revoked immediately.
- Your stored data. If your membership lapses or is terminated, your server-side profile data will be retained for up to 90 days and then deleted. You may request immediate deletion at any time by emailing hello@petcareprocanada.ca.
- Browser data. Profile data stored in your browser (localStorage) remains on your device and is not controlled by CPCP or Barketing Solutions. You can clear it at any time through your browser settings.
CPCP reserves the right to modify, suspend, or discontinue the Maple toolkit at any time without liability to members.
Section 14
Eligibility
To use Maple you must:
- Be at least 18 years of age
- Be operating a legitimate Canadian pet care business
- Hold a current, active CPCP membership in good standing
- Use the toolkit solely for the purposes of your own pet care business
Maple may not be used on behalf of a business you do not own or operate, or to generate content for a third party outside your own organisation. Using Maple for any other purpose is a violation of these terms and may result in access being revoked.
Section 15
Service interruptions and force majeure
Maple relies on third-party infrastructure including Anthropic's Claude API and hosting services. CPCP and Barketing Solutions are not responsible for service interruptions, degraded performance, or unavailability caused by:
- Outages or changes to Anthropic's API or platform
- Server or hosting infrastructure issues outside our control
- Internet connectivity issues
- Cyberattacks, security incidents, or force majeure events including but not limited to natural disasters, pandemics, or government actions
- Required maintenance, updates, or security patches
We will make reasonable efforts to restore service promptly but make no guarantee of uptime or availability. No refund of membership fees will be issued on the basis of toolkit unavailability.
Section 16
Dispute resolution
In the event of any dispute arising from your use of Maple or these terms, both parties agree to first attempt to resolve the matter through good-faith negotiation. Before initiating any legal proceeding, you agree to:
- Contact CPCP in writing at hello@petcareprocanada.ca describing the nature of the dispute
- Allow CPCP and Barketing Solutions 30 days to respond and attempt to resolve the matter
If the dispute cannot be resolved through negotiation within 60 days, either party may pursue resolution through the courts of Ontario as described in Section 17.
Nothing in this clause prevents either party from seeking urgent injunctive or equitable relief from a court where necessary to prevent immediate harm.
Section 17
Governing law and jurisdiction
These Terms of Use and Privacy Notice are governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law principles.
Any dispute, claim, or proceeding arising from or relating to these terms or your use of Maple that cannot be resolved through the process in Section 16 shall be subject to the exclusive jurisdiction of the courts of the Province of Ontario, Canada.
By using Maple, you irrevocably submit to the personal jurisdiction of the courts of Ontario for the purpose of any such dispute.
Section 18
General provisions
Severability. If any provision of these terms is found by a court of competent jurisdiction to be invalid, illegal, or unenforceable, that provision will be modified to the minimum extent necessary to make it enforceable, or severed if modification is not possible. The remaining provisions of these terms will continue in full force and effect.
Entire agreement. These Terms of Use and Privacy Notice constitute the entire agreement between you and CPCP and Barketing Solutions with respect to your use of Maple. They supersede all prior communications, representations, or agreements — including anything stated in CPCP's Mighty Networks community, social media, emails, or events — regarding the toolkit.
No waiver. If CPCP or Barketing Solutions does not enforce any provision of these terms in a particular instance, that does not constitute a waiver of the right to enforce it in the future.
Assignment. You may not assign or transfer your rights under these terms to any other person or entity. CPCP and Barketing Solutions may assign their rights and obligations, for example in the event of a business transfer, without your consent.
Language. These terms are written in English. Any French translation provided is for convenience only. In the event of any inconsistency, the English version governs, except where Quebec law requires otherwise.
